Theewaterskloof Municipality's new liquor sales hours

Theewaterskloof Municipality’s Liquor Trading Hours By-law came into operation on the 2nd of August.
It regulates the liquor sales hours for Villiersdorp, Grabouw, Botrivier, Caledon, Genadendal, Greyton and Riviersonderend. Most on-consumption licenced businesses such as restaurants, pubs and clubs may liquor from 09h00 till 02h00. However businesses located in residential areas  will only be entitled to sell between 09h00 and 11h00. Casinos will be entitled to sell liquor 24 hours a day.

Businesses with off-consumption licences such as supermarkets, liquor stores and wineries may sell liquor from 09h00 to 20h00 but only wineries will be allowed to do so on Sunday.

The by-law has specific hours for so-called “house taverns”. They may sell liquor from 14h00 to 21h00 Monday to Thursday, 14h00 to 24h00 on Friday, 09h00 to 24h00 on Saturday and 14h00 to 21h00 on Sunday. Temporary licences for special events will only allow liquor sales from 09h00 to 22h00.

According to Danie Cronje, the Director of Liquor Law Services at Cluver Markotter Incorporated there are contradictory provisions in the by-law.

In the by-law itself the sales hours for  liquor stores and supermarkets are from 09h00 to 18h00 but in the schedule to the by-law,  which provides more detail, these are 09h00 to 20h00. According to Cronje the more specific provisions of the schedule take precedence  and these businesses may therefore sell until 20h00. Function venues and restaurants in agricultural areas may sell liquor for consumption on the premises from 09h00 till 02h00.

However in respect of function venues and restaurants relating to “wineries” the hours are only from 09h00 to 23h00.

According to Cronje the inconsistency will be brought to the attention of the Municipality.
